{"id":2261,"date":"2022-07-06T12:53:06","date_gmt":"2022-07-06T10:53:06","guid":{"rendered":"https:\/\/hoogells.pl\/legal-alert-international-procurement-instrument-ipi-what-is-it-and-how-could-it-affect-participation-of-non-eu-contractors-in-eu-tenders\/"},"modified":"2024-09-05T16:17:11","modified_gmt":"2024-09-05T14:17:11","slug":"legal-alert-international-procurement-instrument-ipi-what-is-it-and-how-could-it-affect-participation-of-non-eu-contractors-in-eu-tenders","status":"publish","type":"post","link":"https:\/\/hoogells.pl\/en\/legal-alert-international-procurement-instrument-ipi-what-is-it-and-how-could-it-affect-participation-of-non-eu-contractors-in-eu-tenders\/","title":{"rendered":"LEGAL ALERT: International Procurement Instrument (IPI) \u2013 what is it and how could it affect participation of non-EU contractors in EU-tenders?"},"content":{"rendered":"<ul>\n<li>On\u00a0<strong>23<sup>rd<\/sup>June<\/strong>\u00a0<strong>2022<\/strong>\u00a0Regulation 2022\/1031 on <strong>International Procurement Instrument (IPI) \u2013 reciprocity in the treatment of EU contractors participating in tenders from non-EU countries <\/strong>was adopted.<\/li>\n<li>The Regulation 2022\/1031 enables the Commission to undertake\u00a0<strong>investigation <\/strong>into a third-country which uses\u00a0<strong>practices against EU contractors restricting their access<\/strong>\u00a0to the public procurement or concession markets.<\/li>\n<li>If such practices are being used, the Commission can impose\u00a0<strong>IPI measures to restrict the access of third-country contractors to EU public procurements<\/strong>.<\/li>\n<li>This means that the contractors from such third-country may be even\u00a0<strong>excluded from public procurements <\/strong>conducted by EU countries or\u00a0<strong>less points may be awarded to a bid submitted by such contractors<\/strong>.<\/li>\n<li>The IPI measure will\u00a0<strong>affect <\/strong>as well the possibility <strong>to subcontract the part of public procurement to entities from a third-country <\/strong>on which such measure is imposed.<\/li>\n<li>IPI measure will apply only to the procedures initiated after the entry into force of such measure.<\/li>\n<li>IPI may apply not only to contractors from third-countries but also to <strong>goods and services. <\/strong><\/li>\n<li>The Commission each time will define the\u00a0<strong>type\u00a0<\/strong>and the\u00a0<strong>minimum value <\/strong>of procurements that will be covered by the IPI measure. That threshold cannot be less than\u00a0<strong>EUR 15.000.000 (for works)<\/strong>\u00a0and\u00a0<strong>EUR 5.000.000 (for supplies and services)<\/strong>.<\/li>\n<li>The exceptions to the application of IPI measure to procurements are very limited.<\/li>\n<li>As a rule, IPI measure should expire after\u00a0<strong>5 years<\/strong>.<\/li>\n<li>The Regulation 2022\/1031 will enter into force\u00a0<strong>on 29<sup>th<\/sup>August 2022<\/strong>.<\/li>\n<\/ul>\n<p>If you have any further questions regarding IPI, we remain at your disposal.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On\u00a023rdJune\u00a02022\u00a0Regulation 2022\/1031 on International Procurement Instrument (IPI) \u2013 reciprocity in the treatment of EU contractors participating in tenders from non-EU countries was adopted.
