{"id":3442,"date":"2025-06-06T14:54:41","date_gmt":"2025-06-06T12:54:41","guid":{"rendered":"https:\/\/hoogells.pl\/construction-disputes-how-to-talk-instead-of-getting-to-court\/"},"modified":"2025-06-06T15:01:43","modified_gmt":"2025-06-06T13:01:43","slug":"construction-disputes-how-to-talk-instead-of-getting-to-court","status":"publish","type":"post","link":"https:\/\/hoogells.pl\/en\/construction-disputes-how-to-talk-instead-of-getting-to-court\/","title":{"rendered":"Construction Disputes &#8211; How to Talk Instead of Getting to Court?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">On June 5, 2025, the Mediation Center at the National Chamber of Commerce in Warsaw organized the conference <strong>\u201cConstruction Disputes \u2013 Negotiations, Mediation, Court\u201d<\/strong>.Hoogells had the pleasure of attending the event \u2013 \u0141ukasz Kotarba listened in on all three panels: <strong>negotiations, mediation, and disputes<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>One key takeaway that stayed with us:&#13;\nWhat matters most are: a competent supervisor (investor\/contractor), a good legal representative, a good mediator, a good arbitrator, and a good judge.<\/strong>&#13;\n&#13;\n\u00a0<\/p>\n\n<p class=\"wp-block-paragraph\">A truism, a clich\u00e9, or a real challenge? <\/p>\n\n<p class=\"wp-block-paragraph\">If the above individuals are properly prepared and bring quality and decisiveness to their roles, then the chances of a smooth construction process and dispute resolution increase \u2013 regardless of whether it ends up in negotiations, mediation, or court. <\/p>\n\n<p class=\"wp-block-paragraph\">Another observation: while public procurers once used to say <em>\u201cyou knew what you were getting into\u201d<\/em>, now it\u2019s more often: <em>\u201cthe work must be paid for\u201d<\/em>.&#13;\nFortunately, this isn\u2019t just a joke, but a reasonable voice from the audience.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Other important points discussed during the panels:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a0<\/strong><strong>Negotiations<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Negotiations are a tough process. Negotiations are not a game of chess.<\/li>\n\n\n\n<li>Negotiations are unpredictable, whereas in court you know what you\u2019re dealing with \u2013 what we disagree with. Courts, legal counsels, and legal provisions can still surprise at any stage \u2013 and that thrill is what lets us pursue litigation law with passion.&#13;\n&#13;\n\u00a0&#13;\n&#13;\n\u00a0<\/li>\n\n\n\n<li><strong>Reciprocity<\/strong> is the essence of negotiations. Conditional clauses, conditional concessions \u2013 you don\u2019t always have to approach negotiations in a formulaic way, like in the civil code.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Mediation<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Should a mediator be knowledgeable in construction matters, or is a general specialization in dispute resolution enough? We believe that <strong>generality may not be sufficient<\/strong>.<\/li>\n\n\n\n<li>The role of individual meetings \u2013 are joint mediation sessions enough? In our view, <strong>individual meetings are just as important<\/strong>, and can be helpful at every stage of mediation.<\/li>\n\n\n\n<li>Desired traits in mediation and among participants \u2013 <strong>attentiveness, flexibility, agility, creativity<\/strong>.<\/li>\n\n\n\n<li>Plus for the mediator \u2013 they view the dispute from the outside. Such an external perspective can also help in negotiations \u2013 for example, by involving an additional lawyer who wasn\u2019t previously immersed in the facts.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a0<\/strong><strong>Dispute<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>When a case ends up in court, is it the end of the dispute strategy? Or does the strategy simply shift?<\/li>\n\n\n\n<li>Is court a place to recover money or only to minimize losses?<\/li>\n\n\n\n<li>The shorter the litigation, the better \u2013 there are fewer emotions involved. <\/li>\n\n\n\n<li>In the context of arbitration, it&#8217;s worth considering <strong>modifications to arbitration court rules<\/strong>, including <strong>setting caps on legal counsel fees<\/strong>.<\/li>\n\n\n\n<li>Disputes arise from <strong>human error<\/strong>, and in construction \u2013 maybe we need a bit of affection. yIs that even possible?&#13;\n&#13;\n\u00a0&#13;\n&#13;\n\u00a0<\/li>\n<\/ul>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<p class=\"wp-block-paragraph\">.<\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On June 5, 2025, the Mediation Center at the National Chamber of Commerce in Warsaw organized the conference \u201cConstruction Disputes \u2013 Negotiations, Mediation, Court\u201d.Hoogells had the pleasure of attending the event \u2013 \u0141ukasz Kotarba listened in on all three panels: negotiations, mediation, and disputes.
