The same bid selected twice. Two appeals. And back to square one.<\/p>\n\n<p class=\"wp-block-paragraph\"><div>&#13;\n&#13;\nUntil recently, the market was abuzz with the progress of the tender for the E75 Rail Baltica Bia\u0142ystok\u2013E\u0142k section. It seems we have yet another KIO soap opera \u2014 this time involving the supervisory authorities.&#13;\n&#13;\nThe largest tender for supervision and project management on the Polish construction market \u2013 namely, the selection of the General Contract Engineer for the Port Polska project \u2013 is essentially back to square one. A few days ago, the National Appeal Chamber (KIO) issued its ruling on the matter.&#13;\n&#13;\nThe background to the case can be summarised in a few words:&#13;\n&#13;\n<\/div><\/p>\n\n<ul class=\"wp-block-list\">\n<li>selection of the Hill International bid;<\/li>\n\n\n\n<li>appeals;<\/li>\n\n\n\n<li>annulment of the Contracting Authority\u2019s decision on the selection;<\/li>\n\n\n\n<li>re-examination and evaluation of tenders;<\/li>\n\n\n\n<li>the re-selection of the same contractor;<\/li>\n\n\n\n<li>further cancellations;<\/li>\n\n\n\n<li>The National Appeal Chamber and the exclusion of Hill International from the proceedings.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Plotting this on a timeline shows that more than a year has passed since the proceedings were initiated and 3.5 months since the Contracting Authority\u2019s first decision.&#13;\n&#13;\nThe current situation is as follows:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the tender, which had twice been selected as the most favourable by the Contracting Authority (Hill International), was deemed by the National Appeal Chamber to be subject to rejection;<\/li>\n\n\n\n<li>The bid, which had been rejected twice by the contracting authority (Dar Al-Handasah), has been \u2018reinstated\u2019 by the National Appeal Chamber (KIO) and now stands a chance of winning.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">In theory, all bidders still have a chance of winning \u2014 following the National Appeal Chamber\u2019s (KIO) ruling, the contracting authority will reassess the tenders, and contractors dissatisfied with the KIO\u2019s decision may lodge appeals with the court.&#13;\n&#13;\nSo far, there are no consortia comprising companies with 100 per cent Polish capital amongst the frontrunners competing for this contract. Yet it was these consortia that offered prices closest to the contracting authority\u2019s budget \u2014 albeit the highest ones.&#13;\n&#13;\nInterestingly, in this tender procedure, a higher price went hand in hand with higher quality. The consortium with the highest price was also rated highest on the quality criteria. Despite this, the international corporations that offered the lowest prices stand the best chance of winning the contract.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A year of proceedings.
