\nIn court proceedings, it is not only the content of the final ruling that is of significance, but also the timing of its delivery. A premature ruling on key procedural issues may lead to the omission of circumstances requiring a full examination of the evidence and may affect the correct assessment of the parties\u2019 liability. An appropriate response to the opposing party\u2019s procedural initiatives often determines the further course of the dispute.

\nA litigation team led by Jordan Zafirow, a solicitor and partner at Hoogells, represented a construction subcontractor in court in a dispute against two entities \u2013 participants in an investment project. The opposing party consistently sought a partial judgment and the dismissal of the claim against one of the two defendants, arguing that there was no joint and several liability on their part.

\nThe arguments put forward by Hoogells indicated that it would be premature to resolve this issue at this stage of the proceedings, and that an assessment of the scope of the defendants\u2019 liability requires consideration of the full factual and legal circumstances of the case.

\nIn Hoogells\u2019 view, a partial judgment is an appropriate remedy for a different situation \u2013 where, in respect of certain parties to the proceedings, the lack of standing is permanent and so obvious that establishing it does not require any evidential proceedings.

\nThe court did not grant the opposing party\u2019s application and did not deliver a partial judgment.

\nThis case demonstrates that the effective protection of a client\u2019s interests requires not only a comprehensive presentation of the party\u2019s procedural position in \u2018standard\u2019 procedural documents, but also a swift response and skilful use of the available procedural instruments.
