The success of the Aldesa consortium – congratulations and thank you for your trust!

On December 6, 2021, the consortium of contractors Aldesa Construcciones Polska sp.z o.o., Aldesa Construcciones S.A., Coalvi S.A. and China Civil Engineering Contruction Corporation signed a public procurement contract with PKP Polskie Linie Kolejowe S.A., the subject of which will be works on the railway line No. 38 on the Ełk – Korsze section, including electrification. Stage I.

 

We are very pleased to congratulate the winning consortium, especially since Hoogells was also involved in the project.

Everything that happened later in this tender could be described in a suspenseful script for a good TV series. The finale of this “series” turned out to be a success that was the culmination of hard work and commitment of a large group of people. The signed contract concerns the reconstruction of a fragment of the railway line No. 38 on the Ełk – Giżycko section with a total length of approximately 50 km.

A favorable KIO judgment for law firm’s client

On November 12, 2021, at the National Appeals Chamber, we obtained a judgment favourable to our client, which completely rejected the unjustified objections of the appellant regarding the method of verifying and evaluating offer.

 

The appellant tried to undermine:

  • the legitimacy of selecting the most advantageous offer, indicating, inter alia, the fact that the works acceptance protocol containing information about the need to remove minor defects that do not affect the possibility of using the building in accordance with its intended purpose does not constitute a document allowing to demonstrate the fulfilment of the conditions for participation in the procedure in terms of the contractor’s professional capacity, does not confirm the proper execution of the works,
  • the legitimacy of excluding the transparency of the proceeding toward the detailed calculation presented in the context of the explanation of the abnormally low price.

 

Edyta Sikorska-Gałecka, head of claim management at Hoogells, representing our Client – Contracting Authority, showed that the actions taken during the procedure were carried out in accordance with applicable law. KIO fully accepted the arguments presented by our attorney-at-law to prove the legitimacy and validity of the actions taken by the Contracting Authority based on the evidence presented by the Contractor, assessed during the procedure. As a result, the client may proceed to the implementation of investments of a strategic nature from the perspective of providing services aimed at health protection.

We are pleased to announce that Hoogells is a Supporting Company of the Builder for Young Engineers program.

 

Builder for Young Engineers is a social educational program, which aims to support young civil engineers and architects in supplementing their education, expanding professional, practical knowledge, skills and professional competencies.

 

The program has been running since 2017 by the Builder Polska monthly in cooperation with leading companies operating in the field of broadly understood construction and architecture, industry organizations as well as public and private universities.

The next section of  the Via Carpatia with the participation of Hoogells!

 

S19 on the section Haćki – Bielsk Podlaski Zachód junction (with the junction) with a section of the national road No. 66 to the existing national road No. 19 and on the section Bielsk Podlaski Zachód (without a junction) – Boćki junction (with a junction), this is the latest infrastructure investment in the portfolio of Hoogells.

 

Our lawyers support the Contract Engineer, who is the engineering company DTŚ S.A. The function of DTŚ S.A. is to supervise the design and implementation of works and contract management.

In October, Agnieszka Borawska, attorney, joined the Hoogells law firm. Agnieszka supports the claim management team in handling infrastructure projects.

 

Agnieszka Borawska has specialised in legal services for entrepreneurs, in particular regarding the execution of construction investments, real estate transactions and environmental protection matters. In addition, she provides legal counselling in the course of judicial and administrative proceedings, including disputes arising in result of construction investments.

Michał Wojciechowski in September, 2021, joined the Hoogells Law Office team to take on the position of Head of Public Procurement.

 

Michał Wojciechowski is an expert in the field of domestic and EU public procurement law. Hoogells, in response to the needs of our Clients and the market, is expanding its infrastructure team. On June 1, 2021, Bolesław Szyłkajtis joined the team of Law Office lawyers as Head of Infrastructure.
